Stuart clinic cuts free services for illegal immigrants, will require documentation By Hillary Copsey Saturday, October 4, 2008 Volunteers In Medicine free clinic stopped accepting illegal immigrant patients in September because Martin Memorial officials say the health system no longer can afford to provide medical tests for them. Martin Memorial Health Systems provides diagnostic services and therapy — everything from blood analysis to body scans — for the Volunteers In Medicine clinic, which provides free care for impoverished, uninsured Martin County residents. Last year, Martin Memorial did $2.3 million in work for the clinic's 1,000 patients. "We have worked closely with Volunteers In Medicine," Martin Memorial spokesman Scott Samples said. "We both agree that neither of us has the financial resources to continue providing care for undocumented immigrants." Martin Memorial provided $26.4 million in charity care last year. Insurance reimbursements are falling, and the ranks of un- or under-insured patients are growing. The health system is choosing to focus on caring for legal residents, Samples said. Providing long-term care for uninsured patients unable to pay their bills never has been a policy at Martin Memorial, Samples said. But the hospital does provide emergency care to anyone. In at least one case — Luis Alberto Jimenez, an illegal immigrant who called Martin Memorial home for years, at a cost of $1.5 million — emergency care turned into long-term care because the patient had nowhere else to go. That case was rare, Samples said, but does illustrate the larger problem health-care facilities across the country are struggling with — how to treat patients who are in the country illegally. Since September, Volunteers in Medicine is only treating the 100 undocumented patients already enrolled in their program. Volunteers In Medicine's $550,000 annual budget can't pay the bills Martin Memorial used to, Executive Director Mary Fields said. Without those tests, doctors can't really treat a patient. "It's very difficult to tell a doctor to look at a chart different for one patient than for another," Fields said. "To tell someone, 'You can get this, but not that.' That's really hard. You can't do that to someone." Since the new policy went into effect Sept. 12, Volunteers In Medicine still has a month-and-a-half-long waiting list for patient enrollment. All new patients will have to show proof of citizenship or legal immigration status along with meeting the income, insurance and Martin County residency requirements. The clinic's medical director, Dr. Howard Voss, said he sympathizes both with patients and Martin Memorial. Word has gotten out among immigrants — even those still in their native countries — that Martin Memorial is a place to get care, Voss said, and the health system can't absorb the cost forever. "This hospital cannot be the acute care center for a whole nation of Mexicans or Guatemalans," Voss said.

Do you think the real motive here is family wanting money ?STUART — A jury being seated this week will be asked to determine whether Martin Memorial Medical Center should be held liable for a claim of false imprisonment for the way they repatriated a brain-damaged and penniless illegal immigrant back to his native Guatemala in 2003. How the hospital conducted itself during the extradition will be key to the deliberations of jurors in the expected three-week trial, pitting attorneys for Luis Jimenez, 38, and his Indiantown guardian, Montejo Gaspar Montejo, against Martin Memorial. On July 10, 2003, the hospital hired a jet to fly Jimenez out of the country after receiving a court order permitting his return to Guatemala, which an appeals court later determined exceeded the court’s jurisdiction. Since then, Jimenez’s lawyers, including Jack Scarola of West Palm Beach, have accused hospital executives of plotting a “clandestine deportation” in order to take advantage of a narrow window of time between a favorable court ruling and an expected appeal. “I went to law school to try this kind of case,” Scarola said during a recent interview. In court papers, he’s argued the hospital should be liable for money damages — including punitive damages — in part because Martin Memorial officials knew the move amounted to a federal deportation and was beyond the scope of state court, to which they’d turned for help in discharging Jimenez. The former gardener lived at Martin Memorial for two years, racking up $1.5 million in unpaid medical bills following a devastating car crash in 2000 caused by a drunken driver in a stolen van. The collision killed two people and left the now childlike Jimenez comatose with broken bones, a traumatic brain injury and the inability to use his legs. An invalid now cared for by his 73-year-old mother in his boyhood home atop a remote Guatemalan mountain, Jimenez is not expected to attend the trial with Montejo, his cousin by marriage. Hospital attorneys have staunchly defended using a private air ambulance to transfer Jimenez to a rehabilitation center in Guatemala City. In court papers, they note that not only could Martin Memorial — an acute care facility — not provide the extensive and ongoing therapy he required, but no American medical facility would accept him due to his illegal immigrant status. In a prepared statement, Ronda Wilburn, director of marketing communication for Martin Memorial Health Systems, said the burden of paying the health care bill for many undocumented immigrants “is falling on hospitals and health systems that simply cannot afford to pay it.” “We feel it is crucial for government leaders at the state and local levels to step in and work to solve this issue,” Wilburn noted. Martin Memorial attorney Scott Michaud, of Boca Raton, said it’s an important case for the hospital. “We are not trying to prove a point or set some kind of precedent,” Michaud said. “We are simply trying to establish that what we did, we did in good faith, and we think was reasonable and the plaintiffs have a different view.” In a legal pitch to award punitive damages against the hospital, attorney Scarola has argued that as a recipient of federal funds, Martin Memorial “was legally obligated to provide Mr. Jimenez with appropriate medical care, notwithstanding the fact that (he) was unable to pay for such services.” Scarola has argued that despite proof officials offered in court detailing the care Jimenez would receive in Guatemala, testimony showed the country’s health system was ill-equipped to deal with his medical needs and would result in his discharge “out on the streets within days of arriving in Guatemala.” Jimenez’s advocates say after a brief stay, he was discharged because he had no money. Michaud though, countered that Martin Memorial was assured by Guatemalan officials Jimenez would get the necessary medical help. County Harbor-UCLA Medical Center near Torrance has also been affected by the closure. "We don't have the luxury of failing," said Jim Lott, executive director of the Hospital Association of Southern California, a trade organization that is spearheading Thursday's meeting. "If we see even one of these hospitals close, it will have a dramatic ripple effect on the whole health system. It would make a horrible situation even worse." The August closure of the 48-bed emergency room at Martin Luther King Jr.-Harbor Hospital in Willowbrook was the tipping point of a long-simmering problem, Lott said. Four other hospitals or emergency rooms have closed in the last five years, forcing patients in some of the poorest areas near Hawthorne, Gardena and El Segundo into already-crowded hospitals that have had to absorb about 100,000 additional emergency room visits each year. Centinela Freeman Memorial Health System based in Inglewood, along with eight other private hospitals identified by the county, have suffered serious financial repercussions.
